By purchasing or using any product from Booked & Visible ("we," "us," "our"), you agree to these Terms of Service, our Refund Policy, and our Privacy Policy, all of which form a single agreement between you and us. If you do not agree, please do not purchase or use our products.
2. Definitions
"Starter Kit" means the one-time digital bundle described on our sales page, including the personalized onboarding report. "Membership" means the Visible or Booked recurring subscription plans. "Landing Page Add-on" means the custom landing page product available standalone or as part of the Booked membership. "You" and "your business" refer to the individual or business purchasing our products, on whose behalf we assume the purchaser has authority to act.
3. Eligibility
Our products are intended for use by owners and operators of independent home-service trade businesses, currently focused on plumbing businesses. You must be at least 18 years old and authorized to make purchases on behalf of your business to use our products.
4. What's included — and what isn't
Our products are entirely self-serve. Unless a specific product page states otherwise, purchasing from us does not include phone or video consultations, ongoing account management, done-for-you social media posting or ad management, or personalized marketing consulting beyond the written materials and personalized report described at purchase. The personalized onboarding report is a written assessment based on publicly available information about your business (such as your Google Business Profile, website, and reviews) at the time it is prepared — it is informational and does not constitute professional legal, tax, or marketing-agency advisory services.
5. Payment, pricing, and currency
Prices are shown in USD, with CAD pricing available at checkout for Canadian customers. We accept payment through the methods offered at checkout by our payment platform. We may change our prices at any time; price changes take effect for new purchases and, for existing memberships, no earlier than your next renewal date, with reasonable notice given beforehand. Applicable sales tax, if any, is calculated at checkout by our payment platform; you are responsible for any tax obligations arising in your own jurisdiction from your purchase.
6. Memberships: renewal, cancellation, and access after cancellation
Visible and Booked memberships renew automatically on a monthly or annual basis, depending on the plan you select, until cancelled. You may cancel at any time, yourself, through your customer account on our checkout platform — the account link is in every receipt email, or available from the store page — under Settings, then Subscriptions. You're welcome to email us instead if you'd rather, but self-service cancellation doesn't require it. Cancellation stops future billing effective at the end of your current billing period, and we do not refund periods already billed. Once your membership ends, access to membership-only content (the guided curriculum, evergreen content calendar, template library, and outcomes reports) ends with it. Materials you already downloaded under your license (Section 7) remain yours to keep and use under that license. If your Booked membership included a custom landing page, your domain is unaffected by cancellation — as described in Section 9, ownership of it transferred to you permanently once your page went live, regardless of your membership status afterward. What does change is hosting: because your page is hosted on our infrastructure as a Booked benefit (Section 9), we keep it live for 30 days after your membership ends as a grace period — resubscribing within that window keeps your existing page in place. After 30 days without resubscribing, we take the page down; your domain remains yours to point at a replacement of your choosing.
7. License to use; intellectual property
When you purchase a product, we grant you a non-exclusive, non-transferable license to use the guides, scripts, templates, checklists, and reports for your own business only. You may not resell, redistribute, sublicense, or share the materials with any other business or individual outside your own company, and you may not use our materials, methodology, or report structure as the basis for a competing product or service. We retain all intellectual property rights in the materials themselves.
8. Your responsibility when using our materials
Our Starter Kit includes review-request scripts, social post templates, and similar marketing materials. You are solely responsible for using these materials in compliance with applicable laws and platform policies, including consumer protection and advertising laws in your jurisdiction, Google's policies on requesting and displaying reviews, and any applicable guidance on endorsements or testimonials (such as FTC guidance in the United States). We provide these materials as a starting point; we do not review or guarantee that your specific use of them complies with any particular law or platform policy, and we are not liable for how you choose to use them.
9. Landing Page add-on: content you submit to us, and domain handover
If you purchase the Landing Page Add-on, you will provide us with information and content about your business — for example, your business name, service details, photos, and customer testimonials — for the purpose of building your page. You retain ownership of anything you submit. You grant us a license to use that content solely to build, host, and refresh your page. By submitting a testimonial or photo, you confirm you have the right to share it with us (for example, that you have a customer's permission to publish their testimonial). This license to build your page is separate from, and does not by itself include, permission to feature your submitted content (photos, testimonials, or your page itself) in our own marketing — we'll ask for that separately and only use it if you say yes. Exact deliverables and timelines for each tier of this product are set out at What's Included, which forms part of these Terms.
If you choose the "All-In, Domain Included" tier (or receive it as part of a Booked membership), we register a domain on your behalf and, once your page is confirmed live, transfer full ownership of that domain to an account you create. This transfer is final once accepted — from that point, the domain is yours, including responsibility for renewal, and we have no further rights or obligations regarding it.
Your landing page itself is always hosted on our own infrastructure, regardless of which tier you choose or who owns the domain — that's what lets us make quarterly refreshes (a Booked membership benefit) or other updates to your page. If you point your domain's DNS away from our hosting to a different provider, quarterly refreshes and other updates to that page are no longer possible, since we are no longer hosting what's being served at your domain. This applies equally to both tiers and isn't tied to your membership status.
10. No guarantee of results
Our materials are built around practices that commonly improve local search visibility, online reviews, and lead generation for plumbing businesses, but results depend on factors outside our control, including your local market, competition, and how the materials are implemented. We do not guarantee any specific increase in calls, bookings, revenue, or search ranking.
11. Refunds
Refund eligibility is set out in full in our Refund Policy, which forms part of these Terms.
12. Acceptable use
You agree not to use our products for any unlawful purpose; not to copy, scrape, or reproduce our materials for resale or redistribution; not to impersonate us or falsely claim an affiliation with us; and not to use our materials to mislead your own customers. Filing a payment dispute (chargeback) without first contacting us at hello@bookedandvisible.ca is a breach of this agreement to attempt resolution directly first, as described in Section 16.
13. Suspension or termination by us
We may suspend or terminate your access to membership content if you breach these Terms — for example, by reselling or redistributing our materials, or through confirmed payment fraud or abuse. Termination for breach does not entitle you to a refund of amounts already paid.
14. Disclaimers and limitation of liability
Our products are provided "as is," without warranties of any kind beyond what is expressly stated in these Terms. To the fullest extent permitted by law, our total liability for any claim relating to our products is limited to the amount you paid us in the twelve months before the claim arose, and we are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.
15. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of our materials in violation of these Terms or applicable law, or from content you submit to us under Section 9.
16. Disputes and chargebacks
If something isn't right with your order, please contact us at hello@bookedandvisible.ca first — most issues can be resolved directly and quickly. By purchasing from us, you confirm you have read and agree to these Terms and our Refund Policy. If a payment dispute is filed without contacting us first, we may present your recorded agreement to these Terms, together with proof of delivery, to the bank or payment processor handling the dispute.
17. Force majeure
We are not responsible for delays or failures in delivering our products caused by circumstances beyond our reasonable control, such as outages of third-party platforms we rely on to deliver or host our products.
18. Changes to these terms
We may update these Terms from time to time. Continued use of our products after an update means you accept the revised Terms. Material changes will be noted with an updated "last updated" date above.
19. Entire agreement and severability
These Terms, together with our Refund Policy and Privacy Policy, form the entire agreement between you and us regarding our products. If any part of these Terms is found unenforceable, the rest remains in effect.
20. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
